Session Description: EPA finalized the Coal Combustion Residuals (CCR) Rule over two years ago. Developing a compliance strategy for this complex and unique rule, however, has been made particularly difficult with additional uncertainties posed by ongoing rule challenges, passage of the WIIN Act, potential state permitting programs, petitions for reconsideration and stay of deadlines, and litigation seeking to mandate closure of CCR units by removal. This session will provide legal and technical perspectives on the many challenges facing electric utilities in implementing the CCR rule, along with an update on the status of the rule challenges, related litigation, and potential implementation of state CCR permit programs pursuant to the WIIN Act.
